This website is operated by the company Lumelya (hereinafter "we," "our," and "us"), accessible via the domain name lumelya.eu. These General Terms and Conditions of Sale and Use (hereinafter "GTCS/GTCU") exclusively govern the commercial relationship between Lumelya, acting as a professional seller, and any non-professional individual (hereinafter "the Customer" or "you") making a purchase on the site.

ARTICLE 2 – Product characteristics
Lumelya offers nail care products and accessories for sale, described with the greatest possible accuracy on each product page:
- Custom Press-on Nails: False nails created entirely to order and personalized according to the client's choices (size, shape, colors, etc.).
- Sizing Kits: Tools for measuring nail size—essential for the custom creation process—prepared according to the client's choice (shape).
- Prep kits: Standard application accessories.
- Keychains: Standard non-personalized and personalized decorative items.
As all the press on nails are hand-painted, these handcrafted items may exhibit slight variations (in color or pattern) compared to the photographs shown; such variations cannot be considered defects of conformity.
ARTICLE 3 – Determination of sizes and customer responsibility
For any order of custom press-on nails, the customer is required to provide their nail sizes directly when placing the order on the lumelya.eu website.
To help the Client determine their exact measurements, Lumelya provides the following on the website:
- A guided method explaining how to measure your natural nails.
- Size correspondence charts specific to each nail shape offered.
- The option to purchase a Sizing Kit prior to placing an order.
The Customer is solely responsible for the accuracy of the sizes provided when placing their order. Lumelya does not verify the measurements supplied. Consequently, no claims, exchanges, modifications, or refunds will be accepted in the event of a sizing error on the part of the Customer.
ARTICLE 4 – Price and payment terms
Our product prices are quoted in euros, inclusive of all taxes (TTC). Lumelya reserves the right to change its prices at any time; however, products will be billed based on the rates in effect at the time the order is placed.
Full payment is due at the time of the order. Transactions are processed via secure payment systems.
ARTICLE 5 – Right of withdrawal and statutory exceptions
In accordance with Article L.221-18 of the Consumer Code, the consumer-customer generally has a period of 14 days to exercise their right of withdrawal. However, our business is subject to strict legal exceptions:
Standard items (non-personalized keychains): The Customer is entitled to the statutory 14-day right of withdrawal. Items must be returned in new, complete condition and in their original packaging. Return shipping costs are the sole responsibility of the Customer. Refunds will be issued within a maximum of 14 days following receipt and inspection of the goods.
Prep kits: In accordance with Article L.221-28 5° of the Consumer Code, the right of withdrawal does not apply to goods unsealed or opened by the consumer after delivery that cannot be returned for reasons of hygiene.

ARTICLE 6 – Delivery and lead times
As Lumelya’s products are handcrafted and personalized, the processing time depends directly on the nature and volume of the orders to be processed.
- Production (processing) time: The estimated timeframe for creating the press-on nails is generally between 7 and 15 business days (excluding weekends and public holidays) from the time the order is confirmed and the client's size details are fully received. This timeframe may be extended during periods of high demand.
- Delivery time (transit): In addition to the production time, there is the postal transit time (generally 2 to 5 business days for mainland France, depending on the chosen carrier).
In accordance with regulations, Lumelya guarantees that the complete delivery of products will take place within a maximum period of 30 days from the date of purchase. Beyond this time limit, and barring cases of force majeure, the Customer may request the cancellation of their order and a refund.
The Customer is responsible for verifying the accuracy of the provided delivery address. Any parcel reshipped due to an incomplete or incorrect address shall be at the Customer's sole expense.
ARTICLE 7 – Statutory warranties
As a professional seller, Lumelya is liable for any lack of conformity of the goods with the contract (Article L.217-3 et seq. of the Consumer Code) and for hidden defects in the sold item (Articles 1641 et seq. of the Civil Code).
- Statutory warranty of conformity: The Customer has a period of two (2) years from the delivery of the goods to take action in the event of a manufacturing defect (excluding errors regarding size made by the Customer).
- Warranty against hidden defects: The Customer may choose between rescinding the sale and a reduction in the sale price if a hidden defect renders the product unfit for its intended use.
These warranties do not apply in cases of misuse, incorrect application of the false nails, negligence, or normal wear and tear.
ARTICLE 8 – Accuracy of information and errors
We reserve the right to refuse any order placed on our store. Our site may occasionally contain information with typographical errors, inaccuracies, or omissions regarding product descriptions, pricing, or availability. We reserve the right to correct such errors and cancel orders if any information proves to be inaccurate, at any time and without prior notice.
ARTICLE 9 – Intellectual Property
All elements of the lumelya.eu website (texts, visuals, nail designs, photos, logos, product descriptions) are and remain the exclusive intellectual property of Lumelya. Any reproduction, use, or redistribution—even in part—is strictly prohibited without prior written consent.
ARTICLE 10 – Données personnelles et communications (Newsletter et Avis)
Dans le cadre de l’exploitation de sa boutique en ligne, Lumelya est amenée à traiter des données personnelles concernant le Client (nom, prénom, adresse e-mail, historique d’achat), conformément au Règlement Général sur la Protection des Données (RGPD).
- Newsletter et prospection commerciale : Le Client a la possibilité de s’inscrire à la newsletter de Lumelya pour recevoir des informations sur les produits, nouveautés et offres commerciales. Cette inscription repose strictement sur le consentement préalable du Client, exprimé par une démarche active (case à cocher au moment de la commande ou via un formulaire dédié). Le Client peut se désinscrire à tout moment et sans frais en cliquant sur le lien de désinscription présent en bas de chaque e-mail.
- Envoi de formulaires de collecte d’avis : Conformément à l’intérêt légitime de l’entreprise d’améliorer continuellement la qualité de ses produits et services, Lumelya utilise un outil tiers indépendant (CusRev) pour l’envoi automatisé de demandes d’avis suite à une commande. Les données strictement nécessaires à l’envoi de cette sollicitation (prénom, adresse e-mail et produit acheté) lui sont temporairement partagées. Ces invitations n’ont aucun caractère commercial. Le Client dispose d’un droit d’opposition et peut choisir de ne pas soumettre d’avis ou se désinscrire des futures demandes via le lien présent dans le message.
- Utilisation des avis : Les avis ainsi récoltés peuvent être affichés sur le site lumelya.eu et utilisés à des fins de communication sur nos supports et réseaux sociaux officiels de manière anonymisée (prénom et initiale du nom uniquement), sauf accord explicite complémentaire du Client.
ARTICLE 11 – Mediation and applicable law
Les présentes CGV/CGU sont soumises au droit français. En cas de litige, le Client s’adressera en priorité à Lumelya pour obtenir une solution amiable par e-mail. Conformément aux dispositions du Code de la consommation, le Client a le droit de recourir gratuitement à un service de médiation en vue de la résolution amiable de tout litige. Le médiateur de la consommation rattaché à Lumelya est : Société de la Médiation Professionnelle (SMP), SMP Médiation, 24 rue Albert de Mun – 33000 Bordeaux. Après démarche préalable écrite du Client auprès de Lumelya Nails restée infructueuse, le Service du Médiateur peut être saisi pour tout litige de consommation dont le règlement n’aurait pas abouti. Pour connaître les modalités de saisine du Médiateur, le Client peut se rendre sur le site : www.mediateur-consommation-smp.fr. À défaut de résolution amiable, les tribunaux français seront seuls compétents.
